For the purposes of these Conditions, it is understood that the activity that Naturygreencare.com carries out through the Website includes:

  • Sale of cosmetic products manufactured in Spain.

In addition to reading these Conditions, before accessing, browsing, and/or using this website, the User must have read the Legal Notice and the General Terms of Use, including the cookie policy, and the privacy and data protection policy of Naturygreencare.com. By using this Website or by making and/or requesting the acquisition of a product and/or service through it, the User consents to be bound by these Conditions and by all the aforementioned, so if you do not agree with all of it, you should not use this Website.

Likewise, it is informed that these Conditions could be modified. The User is responsible for consulting them each time they access, browse, and/or use the Website since those in force at the time of requesting the acquisition of products and/or services will be applicable.

THE USER

Accessing, browsing, and using the Website confers the status of user (hereinafter referred to, indistinctly, individually as User or collectively as Users), so all the Conditions set forth herein are accepted, from the start of browsing the Website, as well as its subsequent modifications, without prejudice to the application of the corresponding legal regulations as appropriate.

The User assumes responsibility for the correct use of the Website. This responsibility will extend to:

  • Using this Website solely to make legally valid inquiries and purchases or acquisitions.
  • Not making any false or fraudulent purchases. If it could reasonably be considered that a purchase of this nature has been made, it could be canceled and the relevant authorities would be informed.
  • Providing truthful and lawful contact details, such as email address, postal address, and/or other data (see Legal Notice and General Conditions of Use).
  • The User declares to be over 18 years of age and to have legal capacity to enter into contracts through this Website.
  • The Website is intended for Users residing in Spain. Naturygreencare.com does not guarantee that the Website complies with the laws of other countries, whether totally or partially. Naturygreencare.com declines any responsibility that may arise from such access, as well as it does not make shipments or provide services outside of Spain including the Balearic Islands, the Canary Islands, Ceuta, and Melilla).
  • The User may formalize, at their choice, with Naturygreencare.com the purchase and sale contract of the desired products and/or services in any of the languages ​​in which these Conditions are available on this Website.

PURCHASE OR ACQUISITION PROCESS

Users can buy on the Website by the means and forms established. They must follow the online purchase and/or acquisition procedure of https://www.naturygreencare.com, during which several products and/or services can be selected and added to the cart, basket, or final purchase space and, finally, click on "BUY".

Likewise, the User must fill in and/or verify the information requested at each step, although, during the purchase process, before making the payment, the purchase data can be modified.

Subsequently, the User will receive an email confirming that Naturygreencare.com has received their order or purchase request and/or provision of the service, that is, the order confirmation. And, if applicable, they will also be informed by email when their purchase is being shipped.

Once the purchase process is completed, the User consents to the Website generating an electronic invoice that will be sent to the User via email. Likewise, the User can, if desired, obtain a copy of their invoice on paper, requesting it from Naturygreencare.com using the contact spaces on the Website or through the contact details provided above.

The User acknowledges being aware, at the time of purchase, of certain specific sales conditions concerning the product and/or service in question, which are shown alongside its presentation or, if applicable, image on its Website page, indicating, for illustrative purposes, but not exhaustively, and depending on each case: name, price, components, weight, quantity, color, product details, or characteristics, manner in which they will be carried out and/or cost of the services; and acknowledges that the completion of the purchase order or acquisition materializes the full and complete acceptance of the particular sales conditions applicable to each case.

The communications, purchase orders, and payments involved in the transactions carried out on the Website could be archived and kept in the computerized records of Naturygreencare.com in order to constitute a means of proof of transactions, in any case, respecting the reasonable security conditions and the laws and regulations in force in this regard, particularly complying with Regulation (EU) 2016/679 of the European Parliament and of the Council, of April 27, 2016, regarding the protection of natural persons with regard to the processing of personal data and the free circulation of these data (GDPR) and Organic Law 3/2018, of December 5, Protection of Personal Data and guarantee of digital rights, and the rights that Users are entitled to under the privacy policy of this Website.

 

AVAILABILITY

All purchase orders received by Naturygreencare.com through the Website are subject to the availability of the products and/or to the absence of any circumstance or force majeure (clause nine of these Conditions) affecting the supply of the products and/or the provision of services. If there are difficulties regarding the supply of products or if products are out of stock, Naturygreencare.com undertakes to contact the User and refund any amount that may have been paid as payment, using the same payment method used by the user for the acquisition of the goods.

PRICES AND PAYMENT

The prices displayed on the Website are final, in Euros (€), and include taxes unless otherwise required by law, especially regarding VAT, which is indicated and applied differently.

Shipping costs are not included in the final prices of the products as shown on the Website. They will be included and detailed before final payment. Naturygreencare.com performs delivery and/or shipping services through the transport company contracted by Natury, trying to be the most economical at all times and at the same time ensuring the safest care and delivery of the requested merchandise.

The Website will only add additional costs to the price of a product or service automatically in the final payment process, such as VAT and shipping costs, all for the purpose of ensuring that the user has exact knowledge of the total final price before contracting.

Prices may change at any time, but any changes will not affect orders or purchases for which the User has already received a confirmation of the order.

The accepted payment methods will be: Credit or debit card, Paypal, among others.

Naturygreencare.com uses all means to guarantee the confidentiality and security of the payment data transmitted by the User during transactions through the Website. As such, the Website uses a secure SSL (Secure Socket Layer) payment system.

Credit cards will be subject to checks and authorizations by the issuing bank, if said entity does not authorize the payment, the transaction will not be completed, so there will be no contract with the User, and consequently Naturygreencare.com will not be responsible for any delay or non-delivery.

Once Naturygreencare.com receives the purchase order from the User through the Website, and confirmation that the payment has been made through one of the different methods offered by the website, the order will be prepared and shipped. The charge on the card/account will be made at the time of formalizing the payment, and at that time the user will receive the order and payment confirmation.

In any case, by clicking on "BUY" the User confirms that the payment method used is theirs.

DELIVERY

In cases where it is necessary to make the physical delivery of the contracted goods, deliveries will be made in the following territory: Spain including the Balearic Islands, the Canary Islands, Ceuta, and Melilla)

Except in cases of unforeseen or extraordinary circumstances or, where applicable, arising from the customization of the products, the purchase order consisting of the products listed in each purchase confirmation will be delivered within the period indicated on the Website according to the shipping method selected by the User and, in any case, within a maximum period of 30 calendar days from the date of the order confirmation.

If for any reason, attributable to Naturygreencare.com, it could not meet the delivery date, Naturygreencare.com will contact the User to inform them of this circumstance, and they may choose to proceed with the purchase by establishing a new delivery date or cancel the order with a full refund of the price paid. In any case, home deliveries are made on business days.

If it is impossible to make the delivery of the order due to the absence of the User, the order could be returned to the warehouse. However, the carrier would leave a notice explaining where the order is and how to have it delivered again.

If the User will not be at the delivery location at the agreed time, they must contact the assigned transport company to arrange delivery for another day.

If 30 calendar days have elapsed since the order is available for delivery, and it has not been delivered due to reasons not attributable to Naturygreencare.com, Naturygreencare.com will understand that the User wishes to withdraw from the contract and it will be considered terminated by sending a notification to the User to this effect. As a consequence of the termination of the contract, all payments received from the User will be refunded using the same payment method used by the user, except for the additional costs resulting from the User's choice of a delivery method different from the least expensive ordinary delivery method offered within the price on the Website, without undue delay and, in any case, within a maximum period of 14 calendar days from the date on which the contract is considered terminated.

However, the User must bear in mind that the transport derived from the termination may have an additional cost that may be passed on to them.

For the purposes of these Conditions, it will be understood that delivery has been made or that the order has been delivered at the moment when the User, a third party indicated by the User, receives physical possession of the products at the agreed delivery address, which will be evidenced by signing the receipt of the order at the agreed delivery address. A "third party indicated by the User" will be understood to be any third person expressly designated by the User, as well as any third person other than the User and who, being at the agreed delivery address, receives the possession of the order from the Carrier by signing the receipt of the order and identifying themselves to the Carrier.

The risks associated with the products will be borne by the User from the moment of their delivery. The User acquires ownership of the products when Naturygreencare.com receives full payment of all amounts due in relation to the purchase or acquisition made, including shipping costs, or at the time of delivery, if this occurs after receiving the full amount due by Naturygreencare.com.

In accordance with the Value Added Tax (VAT) Law, purchase orders for delivery and/or provision will be deemed located in Spanish VAT territory if the delivery address is in Spanish territory except the Canary Islands, Ceuta, and Melilla. The applicable VAT rate will be the one legally in force at any time depending on the specific article in question.

 

MEDIOS TÉCNICOS PARA CORREGIR ERRORES

It is brought to the User's attention that in the event that they detect an error when entering data necessary to process their purchase request on the Website, they may modify them by contacting Naturygreencare.com through the contact spaces enabled on the Website, and, if applicable, through those enabled to contact customer service, and/or using the contact details provided in clause one (General information).

In any case, before clicking on "BUY", the User has access to the space, cart, or basket where their purchase requests are recorded and can make modifications.

Likewise, the User is referred to consult the Legal Notice and General Conditions of Use and, specifically, the Privacy Policy for more information on how to exercise their right of rectification as established in Regulation (EU) 2016/679 of the European Parliament and of the Council, of April 27, 2016, regarding the protection of individuals with regard to the processing of personal data and the free movement of such data (GDPR) and in Organic Law 3/2018, of December 5, on the Protection of Personal Data and guarantee of digital rights.

RETURNS

In cases where the User acquires products on or through the Website of the owner, they have certain rights, as listed and described below:

Right of Withdrawal

The User, as a consumer and user, makes a purchase on the Website and, therefore, has the right to withdraw from said purchase within a period of 14 calendar days without the need for justification.

This withdrawal period will expire after 14 calendar days from the day the User or a third party authorized by them, other than the carrier, acquired physical possession of the goods purchased on the Website of Naturygreencare.com or in the event that the goods making up their order are delivered separately, 14 calendar days from the day the User or a third party authorized by them, other than the carrier, acquired physical possession of the last of those goods that made up the same purchase order, or in the case of a service contract, 14 calendar days from the day of the conclusion of the contract.

To exercise this right of withdrawal, the User must notify their decision to Naturygreencare.com. They may do so, where appropriate, through the contact spaces enabled on the Website in the returns section or through an email addressed to: info@natury.eco

The User, regardless of the means chosen to communicate their decision, must express clearly and unequivocally their intention to withdraw from the purchase contract. In any case, the User may use the withdrawal methods that Naturygreencare.com makes available to them as an annex to these Conditions on the website returns section, however, its use is not mandatory.

To comply with the withdrawal period, it is sufficient that the communication expressing the unequivocal decision to withdraw be sent before the corresponding period expires.

In case of withdrawal, Naturygreencare.com will refund the User all payments received, except the additional costs chosen by the User for a shipping method different from the least expensive method offered on the Website, without undue delay and, in any case, no later than 14 calendar days from the date on which Naturygreencare.com is informed of the decision to withdraw by the User and the return of the withdrawn product has been received.

Naturygreencare.com will refund the User using the same payment method that the User used for the initial purchase transaction. This refund will not generate any additional costs for the User. However, Naturygreencare.com will withhold the refund until the products or items of the purchase have been received, or until the User presents proof of their return, whichever condition is met first.

The User must also return or send the products to Naturygreencare.com and must do so without undue delay and, in any case, no later than 14 calendar days from the date on which Naturygreencare.com was informed of the decision to withdraw.

Naturygreencare.com does not assume or carry out the withdrawal of the products that the User wants to return, in case of exercising the right of withdrawal. Consequently, the User may use the return system they deem appropriate to return the products by their own means to Naturygreencare.com. Consequently, the User acknowledges and accepts that they must bear the cost of said return (transport, delivery) of the goods, which will not be reimbursed by Naturygreencare.com. In addition, the User will be responsible for any decrease in the value of the products resulting from handling other than that necessary to establish the nature, characteristics, and operation of the goods.

The User acknowledges knowing that there are exceptions to the right of withdrawal, as approved by the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws. By way of example, and not exhaustive, this would be the case for: personalized products; products that may deteriorate or expire quickly; products without their packaging, as it is sealed in the factory; products that for reasons of hygiene or health are sealed and have been unsealed after delivery, or products used while the remaining product is in good condition.

In the same sense, the provision of a service that the User could contract on this Website is governed by this same Law, since it establishes that the Right of withdrawal will not assist Users when the provision of the service has been completely executed, or when it has begun, with the express consent of the consumer and user and with their acknowledgment that, once the contract has been completely executed by Naturygreencare.com, they will have lost their right of withdrawal.

In any case, no refund will be made if the product has been used beyond mere opening, of products that are not in the same conditions in which they were delivered or that have suffered any damage after delivery.

Likewise, products must be returned using or including all their original packaging, instructions, and other documents that accompany them, as well as a copy of the purchase invoice.

Return of defective products or shipping error

These are all cases in which the User considers that, at the time of delivery, the product does not conform to what is stipulated in the contract or purchase order, and therefore must contact Naturygreencare.com immediately and inform them of the existing discrepancy (defect/error) by the same means or using the contact details provided in the previous section (Right of Withdrawal).

The User will then be informed about how to proceed with the return of the products, and these, once returned, will be examined and the User will be informed, within a reasonable period, whether a refund is appropriate or, where appropriate, its replacement.

The amount paid for those products that are returned due to any defect, when it actually exists, will be fully refunded, including delivery costs and any costs that the User may have incurred to return them. The refund will be made by the same payment method that the User used to pay for the purchase.

If the product is damaged on the outside, the customer must immediately notify the carrier through a note. If there is an issue inside the package, it must be reported to Natury, who will notify the transport company.

The transport of the damaged product and the replacement will be borne by the carrier being managed by Natury with the transport company and with total indemnity for the User.

In any case, the rights recognized in the current legislation will always be observed for the User, as a consumer and user.

Guarantees

The User, as a consumer and user, enjoys guarantees on the products that may be acquired through this Website, in the legally established terms for each type of product, with Naturygreencare.com being responsible for the lack of conformity of the same that manifests within a period of two years from the delivery of the product.

In this sense, it is understood that the products are in conformity with the contract as long as: they conform to the description given by Naturygreencare.com and possess the qualities presented therein; they are suitable for the uses normally intended for products of the same type; and they present the usual quality and performance of a product of the same type and that are fundamentally expected of it. When this is not the case with respect to the products delivered to the User, the User must proceed as indicated in the section "Return of defective products or shipping error." However, some of the products marketed on the Website may present non-homogeneous characteristics as long as these derive from the type of material with which they have been manufactured, and therefore will form part of the individual appearance of the product, and will not be considered a defect.

DISCLAIMER OF LIABILITY

Unless otherwise provided by law, Naturygreencare.com shall not accept any liability for the following losses, regardless of their origin:

  • Any losses not attributable to any breach on its part; business losses (including loss of profit, revenue, contracts, anticipated savings, data, loss of goodwill, or incurred unnecessary expenses); or any other indirect loss that was not reasonably foreseeable by both parties at the time the contract of sale of the products between both parties was formalized.

Similarly, Naturygreencare.com also limits its liability in the following cases:

  • Naturygreencare.com applies all measures concerning providing a faithful display of the product on the Website; however, it shall not be responsible for minimal differences or inaccuracies that may exist due to screen resolution issues or browser problems used by the User or others of this nature.

  • Naturygreencare.com shall act with the utmost diligence to make the product subject to the purchase order available to the company responsible for transporting the product. However, it shall not be liable for damages arising from the malfunction of transportation, especially due to causes such as strikes, roadblocks, and in general any other typical causes in the sector, resulting in delays, losses, or theft of the product.

  • Technical failures due to fortuitous or other reasons that prevent the normal operation of the service via the internet. Lack of availability of the Website due to maintenance reasons or others, which prevent access to the service. Naturygreencare.com makes every effort to carry out the process of purchasing, payment, and shipping/delivery of the products; however, it exempts itself from liability for causes that are not attributable to it, fortuitous events, or force majeure.

  • Naturygreencare.com shall not be responsible for the misuse and/or wear and tear of the products used by the User. At the same time, Naturygreencare.com shall not be responsible for incorrect returns made by the User. It is the User's responsibility to return the correct product.

In general, Naturygreencare.com shall not be held responsible for any breach or delay in fulfilling any of the obligations assumed, when the same is due to events that are beyond its reasonable control, i.e., due to force majeure, which may include, but is not limited to:

  • Strikes, labor disputes, or other industrial actions.

  • Civil unrest, riot, invasion, threat or terrorist attack, war (declared or not), or threat or preparation for war.

  • Fire, explosion, storm, flood, earthquake, subsidence, epidemic, or any other natural disaster, pandemics, etc.

  • Inability to use trains, ships, airplanes, motor transport, or other means of transportation, public or private.

  • Inability to use public or private telecommunications systems.

  • Acts, decrees, legislation, regulations, or restrictions of any government or authority.

In this way, the obligations shall be suspended during the period in which the force majeure event continues, and Naturygreencare.com shall have an extension of the period to fulfill them for a period of time equal to the duration of the force majeure event. Naturygreencare.com shall make every reasonable effort to find a solution that allows it to fulfill its obligations despite the force majeure event.

In any case, the User's rights of resolution or withdrawal in such cases shall remain intact.

 

WRITTEN COMMUNICATIONS AND NOTIFICATIONS

By using this Website, the User agrees that the majority of communications with Naturygreencare.com shall be electronic (via email or notices posted on the Website).

For contractual purposes, the User consents to using this electronic means of communication and acknowledges that all contracts, notices, information, and other communications sent by Naturygreencare.com electronically meet the legal requirements of being in writing. This condition shall not affect the User's rights recognized by law.

WAIVER

No waiver by Naturygreencare.com of a specific legal right or action or failure to enforce strict compliance by the User with any of its obligations shall constitute a waiver of other rights or actions arising from a contract or the Conditions, nor shall it relieve the User of its obligations.

No waiver by Naturygreencare.com of any of these Conditions or the rights or actions arising from a contract shall be effective unless it is expressly stated to be a waiver and is formalized and communicated to the User in writing.

ENTIRE AGREEMENT

These Conditions and any document expressly referred to in them constitute the entire agreement between the User and Naturygreencare.com regarding the subject matter of the purchase and sale and supersede any other agreement, covenant, or promise previously made orally or in writing by the same parties.

The User and Naturygreencare.com acknowledge that they have entered into a contract without relying on any statement or promise made by the other party, except as expressly stated in these Conditions.

DATA PROTECTION

The personal information or data provided by the User to Naturygreencare.com during a transaction on the Website shall be treated in accordance with the provisions of the Privacy Policy or data protection (contained, if applicable, in the Legal Notice and General Terms of Use).
